Peta regulasi dan kebijakan ini selanjutnya dikomparasikan dengan sejumlah bentuk penikmatan (enjoyment) yang telah didapatkan oleh masing-masing kelompok minoritas. Berdasarkan Instrumen HAM internasional, Negara adalah pihak yang secara hukum internasional terikat dalam perjanjian HAM. Dalam konteks tersebut, Negara memiliki kewajiban untuk menghormati, melindungi, dan memenuhi HAM dengan unsur kewajiban untuk bertindak (obligation to conduct) dan kewajiban untuk berdampak (obligation to result). Kewajiban untuk bertindak mensyaratkan negara melakukan langkah-langkah melaksanakan pemenuhan suatu hak.
