Laporan ini merupakan pengamatan awal yang dilatarbelakangi oleh kesadaran akan pentingnya memperkuat kewajiban Komnas HAM menyampaikan laporan tahunan. Laporan ini didahului dengan kajian pemetaan atas kebijakan dan regulasi yang menjadikan lima kelompok minoritas ini sebagai sasaran atau sebagai kelompok terdampak. Peta regulasi dan kebijakan ini selanjutnya dikomparasikan dengan sejumlah bentuk penikmatan (enjoyment) yang telah didapatkan oleh masing-masing kelompok minoritas. Berdasarkan Instrumen HAM internasional, Negara adalah pihak yang secara hukum internasional terikat dalam perjanjian HAM.
