L'eccezione come regola nel diritto penale
Fin dai Digesta promulgati da Giustiniano, la “terribilità” è la nota che più e meglio caratterizza la giustizia penale. Da essa discendono quelle particolarità della materia che sono le garanzie, ossia i limiti operativi a tutela della persona indagata, processata e punita. Si tratta di uno sta- tuto proprio ed esclusivo del diritto penale. L’eccezionale gravità della sanzione penale richiede presidi altrettanto eccezionali, che talvolta arrivano a derogare alla disciplina degli altri rami dell’ordinamento giuridico. Il loro attuale assetto è un lascito della tradizione illuministica e liberale. L’odierna metamorfosi di questo modello non può lasciare indifferenti, nonostante la generalizzata assuefazione al “nuovo penale” che avanza.
