Secessionist Rule

The book examines all relevant models which have been employed in settling ethno-territorial conflicts since the time of the League of Nations. Eight of these models have been studied in-depth. The aim of this analysis is to gain expertise and insights that could prove relevant to resolving the conflict in Nagorno-Karabakh. This potential is evaluated in the closing chapters of the volume where novel ideas on how to apply the lessons of these cases to the conflict in Nagorno-Karabakh are presented. This conflict carries many features typical of ethno-territorial conflicts in present and past times: it is neither unique, nor does its settlement depend on others than the parties to the conflic...

The book, which covers contributions from leading international and European law scholars and analyzes the legal and political status quo of non-recognized entities, comprises three parts. The first and the second part focus on contemporary trends of legal theory and practice concerning issues pertaining to secession and non-recognized entities in international and European law, respectively. Additionally, it touches upon EU policies, the issue of EU citizenship in light of secessionist movements in Europe, and the phenomenon of exterritorial naturalization within non-recognized entities. The third part scrutinizes the legal systems of non-recognized entities in the post-Soviet area, covering Eastern Ukraine, Abkhazia, South Ossetia, Transnistria, and Nagorno-Karabakh.

Different Shades of the Past

In his book 21 Lessons for the 21st Century the historian Yuval Noah Harrari wrote that man had the possibility to conquer the world precisely because he could create fictional stories and believe in them. People created more and more complex stories about themselves that served and continue to serve, according to the professor of the University of Jerusalem, building unity, social harmony and gaining power. A narrative about past, in which memory fragmentation and victimisation play a large role, may be a temptation to instrumentalise the past. This is especially true in relation to the events of the twentieth century, when a series of bloody war conflicts occurred. As shown in the following post-conference volume, today the wars of the past (World War I and World War II, Indian-Pakistani war) and current conflicts (Russo-Ukrainian war, war in Sudan or Nagorno-Karabakh) are also a catalyst for the process of instrumentalisation. This process can be analysed both at the level of the evolution of the language of conflict, including the erosion of the values of democratic dialogue, and the use of specific means of commemorating the past (monuments, museums, the Internet).

THE CHANGING PERSPECTIVES AND ‘NEW’ GEOPOLITICS OF THE CAUCASUS IN THE 21ST CENTURY

The change of the geopolitical realities and dynamics, the latest regional developments and the emergence of a new perception of security due to the new situation in Karabakh have changed current perspectives in the South Caucasus region. This book will provide a comprehensive introduction for students, academics, media representatives, business persons and those who are interested in the region. Over the last decade the "transition paradigm", which is based on the conviction that authoritarian political systems would over time necessarily develop into democracies, has been subjected to serious criticism. The complex political and societal developments in the post-Soviet region in particular have exposed flaws in the claim that a shift from authoritarianism to democracy is inevitable. Using case studies from the post-Soviet region, a broad range of international contributors present an original and innovative contribution to the debate. They explore the character of post-Soviet regimes and review the political transformations they have experienced since the end of the Cold War. Throu...

In order to analyse configurations of power that transcend the territorial trap, the Caucasus is an excellent case in point. Its past and present exhibit an extraordinary richness in power practices of diverse forms that intersect on various scales. This comprehensive volume offers an innovative procedural perspective on the actual workings of power not necessarily tied to the nation-state. Its focus goes well beyond national scales to tackle the manifold impacts of transboundary flows. The authors, from a wide range of academic disciplines, provide original empirical data from this intriguing but largely untapped region, with respect to the critical study of statehood. They also shed light ...
