Do ponto de vista funcional, a hegemonia da função reparatória ou compensatória e a insuficiência dessa perspectiva – que se preocupa apenas com o momento ex posteriori ao dano – para atender às novas demandas sociais, configura-se como entrave para maior abrangência do instituto. Necessário, pois, revisitá-lo, para compreender sua finalidade e identificar possíveis limites de atuação, mediante utilização de visão mais abrangente e dinâmica, possibilitada pela operabilidade, com utilização das cláusulas gerais e da hermenêutica, descortinando, assim, os caminhos para a multifuncionalização da responsabilidade civil.
