O Excesso na Legítima Defesa à Luz dos Fins das Penas
A situação de legítima defesa coloca o agredido perante o ter de se decidir num cenário de urgência, não antecipada, num contexto no qual emoção, razão e vontade se conjugam na exigência, feita ao paciente-agente, de razões existenciais de agir. E é aí que muitas vezes ocorre o excesso. Situações destas não só provam o paciente-agente, como colocam à prova também o Direito Penal na sua concretização histórica. A presente obra articula razão, emoções e vontade insistindo num Direito Penal da culpa ética, num contexto global, plural e multicultural, e faz uma apologia de fins predominantemente ético-retributivos, se bem que acompanhados de finalidades preventivas da pena. O acento problemático e discursivo é o regime penal português do excesso, mas com alguns cruzamentos com outras áreas do conhecimento, como Filosofia, Sociologia, História, Semiótica, Psicologia, Teologia, etc.
