Introduzido pela primeira vez no nosso ordenamento com a promulgação da Constituição de 1934 e sem igual no Direito de qualquer outro país. É pois Ação de natureza jurídica Constitucional Cível, mas sendo aplicado nas áreas trabalhista e criminal. Encontra-se amplamente discutido e é objeto de estudo de muitos doutrinadores e juristas, que definem e defendem esse remédio por ser ele tão eficaz e célere à justiça. Este instituto tão manipulado nos dias atuais recebeu mais uma reformulação. Foi no Diário Oficial de União de 10 de Agosto de 2009 que a Lei 12.016/09 revogou a então em vigor Lei 1.533/51. Satisfatória para alguns e falha para outros, a nova Lei pretende dar mais eficiência e celeridade no processamento do Mandado de Segurança.
