Esta tese ancora-se na idéia de que a cidadania só pode ser plena a partir do conhecimento que os detentores e destinatários do poder numa democracia - os cidadãos - possam deter sobre a estrutura jurídico-política do estado de direito. O pressuposto necessário dessa assertiva é que a efetivação do discurso dos direitos, de cunho constitucional, só pode materializar-se naquilo que se denomina de "a luta pelos direitos."
