A obra reúne uma coletânea de artigos relacionados à temática de Direitos Fundamentais, analisada sob distintas abordagens oriundas da participação de professores e alunos no Grupo de Estudos Avançados em Direito – GEAD/UNIPAMPA e no Grupo de Pesquisa em Direito Constitucional e Propriedade Intelectual - DIRCONPI/UNIPAMPA. Compreender a efetividade dos direitos fundamentais na contemporaneidade envolve múltiplos questionamentos sobre a operacionalização do direito, bem como necessária ruptura com os paradigmas de interpretação tradicional das normas constitucionais a fim de adequar as novas concepções hermenêuticas. Perante uma sociedade mutável, perfaz nas Ciências Jurídicas a necessidade de interpretar e aplicar as normas e, sobretudo, discutir de forma científica para a concretude dos Direitos Fundamentais.
São múltiplos os temas possíveis de serem examinados em relação à categoria da Fraternidade. Os Direitos Humanos, a Justiça Social e a Tecnologia correspondem, cada qual a seu modo, a algumas dessas possibilidades de análises, as quais, trazidas para a atualidade da Sociedade em Rede, carregam um desafio: conferir fundamentos ao ser humano para estar em trânsito no comando tecnológico, atento à promoção, proteção e defesa dos direitos inerentes. Essa “lógica”, tão importante à Fraternidade, dá conta de uma justificada cooperação digital, servindo de parâmetros a favor dos Direitos Humanos, do adequado acesso à justiça Social e da realidade tecnológica, justificando a urgente tarefa de estudos relativos a tais matérias, a permitir a revisão das variadas temáticas que orbitam em torno dessas questões e que estão a reforçar a importância dessas referências para o estado da Fraternidade e de seus desafios na Sociedade em Rede.
