Die Verpflichtungszusage des Ligaverbandes gegenüber der EU-Kommission
Die Bundesliga-Übertragungsrechte werden seit Einführung der Fußball-Bundesliga im Jahr 1963 zentral, also gebündelt von einem Anbieter vermarktet. Seit jeher kreisen juristische Diskussionen um die Kartellrechtmäßigkeit dieser Vermarktungspraxis. Im Jahr 2005 erging mit der «Bundesliga-Entscheidung» der EU-Kommission erstmals eine gerichtliche Entscheidung zu dieser Frage. Gleichfalls wandte die EU-Kommission in diesem Verfahren zum ersten Mal das neu geschaffene Rechtsinstitut der Verpflichtungszusage an. Im Zuge dessen verpflichtete sich der Ligaverband zu erheblichen Änderungen seines Vermarktungsmodells. Im Gegenzug teilte die EU-Kommission mit, dass an dem modifizierten Vermarktungsverfahren keine kartellrechtlichen Bedenken mehr bestünden. Aufgrund des erheblichen Einflusses der «Bundesliga-Entscheidung» auf die gegenwärtige und zukünftige Bundesliga-Vermarktung besteht ein besonderes Bedürfnis an einer Überprüfung dieser Entscheidung. Eine solche hat sich diese Untersuchung zur Aufgabe gemacht. Überdies beantwortet sie die Frage, wie die Rechtsnatur der Übertragungsrechte einzuordnen ist und wer deren Inhaber sind.
