The newly enacted Digital Markets Act (DMA) finds itself at a crossroads. The DMA can develop into a specialist field of competition law for digital platforms or it can evolve into a new field of EU law, detached from competition law. The DMA's ultimate trajectory will depend on the legal characterization given to the DMA. Is it a special competition law regime or an original instrument distinct from competition law? This paper lays the groundwork for characterizing the DMA by offering a complete descriptive analysis of the instrument. Among the elements discussed are the twin concepts of “gatekeepers” and “core platform services”, which together condition the DMA's scope of application, as well as the legal obligations imposed on gatekeepers. The paper proposes a novel categorisation of the obligations, showing that each obligation can be associated with at least one of two conventional competition law concerns (exclusion or exploitation). The discussion shows the difficulty of pinpointing the exact nature of the DMA. We argue that this ambiguity creates challenges for the practical implementation of the DMA.

On December 15, 2020, the European Commission released a proposal for a Digital Markets Act (DMA). The DMA targets so-called 'gatekeepers': large digital platforms that have become important gateways for business users and end users. The DMA imposes on gatekeepers a set of obligations amounting to prohibitions of commonplace digital platform practices. It is hard to understate the importance of the Commission's initiative. The DMA, together with its sister proposal for a Digital Services Act, amounts to the most significant overhaul of the digital regulatory landscape to date. A provisional political agreement on the DMA text was reached between the Commission, the Parliament and the Council...

Big Tech and the Digital Economy

This book asks a simple question: are the tech giants monopolies? In the current environment of suspicion towards the major technology companies as a result of concerns about their power and influence, it has become commonplace to talk of Google, Facebook, Amazon, Apple, Microsoft, or Netflix as the modern day version of the 19th century trusts. In turn, the tech giants are vilified for a whole range of monopoly harms towards consumers, workers and even the democratic process. In the US and the EU, antitrust, and regulatory reform is on the way. Using economics, business and management science as well legal reasoning, this book offers a new perspective on big tech. It builds a theory of "mol...

Bioactive Molecules in Food

This reference work provides comprehensive information about the bioactive molecules presented in our daily food and their effect on the physical and mental state of our body. Although the concept of functional food is new, the consumption of selected food to attain a specific effect existed already in ancient civilizations, namely of China and India. Consumers are now more attentive to food quality, safety and health benefits, and the food industry is led to develop processed- and packaged-food, particularly in terms of calories, quality, nutritional value and bioactive molecules. This book covers the entire range of bioactive molecules presented in daily food, such as carbohydrates, protei...

This is the first EU competition law treatise that fully integrates economic reasoning in its treatment of the decisional practice of the European Commission and the case-law of the European Court of Justice. Since the European Commission's move to a "more economic approach" to competition law reasoning and decisional practice, the use of economic argument in competition law cases has become a stricter requirement. Many national competition authorities are also increasingly moving away from a legalistic analysis of a firm's conduct to an effect-based analysis of such conduct, indeed most competition cases today involve teams composed of lawyers and industrial organisation economists. Competi...
