Esta obra es resultado de la colaboración y la cohesión entre investigadores de los grupos Socio-Humanística del Derecho, Raimundo de Peñafort y Aletheia de la Universidad Santo Tomás, articulados en torno a la pregunta por el estado de la cuestión del sistema modular, de su estatuto teórico, de su método y de su aplicación, toda vez que este se conforma en la impronta de formación de los profesionales del derecho. Para responder esta pregunta se empleó el método prudencial de ver, juzgar y actuar, propio del sistema modular, que por su riqueza facilita las labores de análisis y crítica. Por lo anterior, se trata, sin duda, de una contribución relevante para las investigaciones interdisciplinares en torno a la pedagogía y al diseño de currículo en la educación superior.
Esta obra es el resultado del trabajo de diferentes grupos de autores articulados a través del Centro de Investigaciones Francisco de Vitoria, de la Facultad de Derecho de la Universidad Santo Tomás. Estos investigadores han logrado reunir sus esfuerzos para contribuir al debate y el desarrollo de lo que hoy se conoce como la Declaración Universal de Derechos Humanos Emergentes (dudhe). La dudhe representa la expresión de voluntades de la sociedad civil, cuyo propósito es promover la revisión y ampliación del marco de derechos humanos existente y así superar los retos que plantean contextos de violaciones continuas y crecientes de los derechos humanos a nivel global. Las diferentes perspectivas recogidas aquí constituyen un importante aporte a la construcción de la paz en Colombia, en un momento histórico de transición que parte del reconocimiento de las graves violaciones de derechos humanos que han tenido lugar en el marco del conflicto armado colombiano y de la necesidad de que se materialicen reformas estructurales para reducir las desigualdades y la discriminación en el país.
O presente trabalho buscou um caminho para a construção de bases dogmático-normativas para a justiça restaurativa no Brasil, diante de um fenômeno jurídico sofisticado que consiste na transformação de uma soft law em uma hard law, sem intermediação legislativa.
