"En el presente libro se desarrollan los aspectos centrales del Control de Convencionalidad, y por ello la referencia a lo “dogmático”, por cuanto se hacía necesaria la configuración de elementos teóricos básicos y referenciales para abordar el tratamiento de un nuevo ámbito de especialización, en particular porque este resulta aplicable a las nuevas circunstancias en las cuales los países adscritos al Sistema Interamericano de Protección de Derechos Humanos se encuentran vinculados. En tal sentido, la tutela de Derechos Humanos, en particular en el contexto americano, impone un nuevo mecanismo de evaluación, tanto en el ámbito de la jurisdicción nacional como también de la supranacional y ante ello se requiere partir de bases sólidas conceptuales para así poder extender los elementos procesales y procedimentales en los cuales se aplicará la Convención Americana sobre Derechos Humanos".
Los acuerdos de paz son estudiados en la pre-sente propuesta como referencia (Filipinas, Irlanda del Norte, Sudán del Sur, El Salvador y Colombia). Ayudan a comprender que la tan anhelada paz (estable y duradera) solo puede ser pronta, rígida y transformadora si se comprenden el conjunto de medidas mínimas requeridas. Depende de acuerdo con la capacidad institucional de cada Estado, puesto que no existe una única fórmula internacional e interinstitucional en el marco de un acuerdo de paz. Este hecho hace que la presente propuesta lleve consi-go un plus elemental para evaluar las condiciones y medidas (en todos sus niveles) en el desarrollo del acuerdo.

The customary law of belligerent occupation goes back to the Hague and Geneva Conventions. Recent instances of such occupation include Iraq, the former Yugoslavia, the Congo and Eritrea. But the paradigmatic illustration is the Israeli occupation, lasting for over 40 years. There is now case law of the International Court of Justice and other judicial bodies, both international and domestic. There are Security Council resolutions and a vast literature. Still, numerous controversial points remain. How is belligerent occupation defined? How is it started and when is it terminated? What is the interaction with human rights law? Who is protected under belligerent occupation, and what is the scope of the protection? Conversely, what measures can an occupying power lawfully resort to when encountering forcible resistance from inhabitants of the occupied territory? Counterinsurgency is those military, paramilitary, political, economic, psychological, and civic actions taken by a government to defeat insurgency (JP 1-02). It is an offensive approach involving all elements of national power; it can take place across the range of operations and spectrum of conflict. It supports and influences an HN’s IDAD program. It includes strategic and operational planning; intelligence development and analysis; training; materiel, technical, and organizational assistance; advice; infrastructure development; tactical-level operations; and many elements of PSYOP. Generally, the preferred methods of support are through assistance and development programs. Leaders must consider the roles of military, intelligence, diplomatic, law enforcement, information, finance, and economic elements (MIDLIFE) in counterinsurgency.
