This book reflects on the problematic relation of ethics to politics in our 'democratic' era. If democracy implies the loss of an ultimate foundation for both ethics and political action, how can it be defended against its (ultra-nationalist, fundamentalist, ...) critics. Are there reasons for being a 'democrat' and what does it mean to be so or to act 'democratically'. Does this merely imply strict obedience to certain procedures that we call 'democratic' or does a democratic society ask for a democratic attitude or ethos. If so, how can this ethos be defined and grounded. All contributions to this volume articulate answers to these questions or to problems intrinsically related to them (i.e. what is the status of the law when it loses ultimate foundation). They do so by reflecting on the work of some important contemporary French philosophers: Lefort, Lyotard, Derrida, Levinas, Lacan, etc

Crimes against Humanity
This book traces the evolution of crimes against humanity (CAH) and their application from the end of World War I to the present day, in terms of both historic legal analysis and subject-matter content. The first part of the book addresses general issues pertaining to the categorization of CAH in normative jurisprudential and doctrinal terms. This is followed by an analysis of the specific contents of CAH, describing its historic phases going through international criminal tribunals, mixed model tribunals and the International Criminal Court. The book examines the general parts and defenses of the crime, along with the history and jurisprudence of both international and national prosecutions. For the first time, a list of all countries that have enacted national legislation specifically directed at CAH is collected, along with all of the national prosecutions that have occurred under national legislation up to 2010.
The Western Codification of Criminal Law
This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.
