Segundo o preconizado pelo artigo 225, § 1o, da Constituição federal de 1988, o município, enquanto ente integrante da Federação Brasileira, possui competência para a instituição de normas específicas visando a proteção e preservação dos recursos ambientais. Dessa feita, exsurge a problemática acerca da possibilidade de implementação da extrafiscalidade tributária, como meio de preservação dos recursos hídricos nos municípios, considerando os limites e a outorga de competência conferidos pela Carta Cidadã. Nesse sentido, o foco central do presente livro funda-se na análise da competência dos municípios para legislar e implementar tributos com a finalidade extrafiscal, visando à proteção dos recursos hídricos como forma de garantir a efetivação do direito fundamental ao meio ambiente sustentável.
