Corte di Strasburgo e giustizia penale
La Convenzione europea dei diritti dell’uomo e la giurisprudenza della Corte di Strasburgo sono oggi sempre più avvertite come parti integranti del diritto che il giudice penale e quello della prevenzione sono chiamati quotidianamente ad applicare, nella loro veste di “primi garanti” dei diritti convenzionali. Dal punto di vista dell’avvocato, d’altra parte, la Convenzione e la sua interpretazione possono oggi rivelarsi strumenti preziosi durante il procedimento penale, per sollecitare il superamento di prassi interpretative consolidate e/o la formulazione di questioni di legittimità costituzionale. Questa nuova edizione del volume illustra in maniera sistematica la giurisprudenza della Corte relativa alle disposizioni convenzionali rilevanti in ambito penale, tenendo conto delle importanti novità intervenute dal 2016 a oggi.
Le modifiche al sistema sanzionatorio penale
Il terzo volume analizza i plurimi interventi realizzati dalla riforma Cartabia sul sistema sanzionatorio penale con l’obiettivo, per un verso, di ridurre il più possibile il ricorso alla pena carceraria soprattutto quando vengono in gioco pene detentive brevi e, per altro verso, di deflazionare il sistema della giustizia penale. Sotto il primo profilo, vengono esaminate le novità concernenti le nuove pene sostitutive delle pene detentive e la pena pecuniaria, mentre sotto il secondo profilo viene riservato ampio spazio all’estensione dell’ambito di applicazione della non punibilità per particolare tenuità del fatto, della messa alla prova e della perseguibilità a querela.
