As president of the Italian Liberal Party, Benedetto Croce was one of the most influential intellectuals involved in Italian public affairs after the fall of Mussolini. Placing Croce at the centre of historical events between 1943 and 1952, this book details his participation in Italy's political life, and his major contributions to the rebirth of Italian democracy. Drawing on a great amount of primary material, including Croce's political speeches, correspondences, diaries, and official documents from post-war Italy, this book illuminates the dynamic and progressive nature of Croce's liberalism and the shortcomings of the old Liberal leaders. Providing a year-by-year account of Croce's initiatives, author Fabio Fernando Rizi fills the gap in Croce's biography, covering aspects of his public life often neglected, misinterpreted, or altogether ignored, and restores his standing among the founding fathers of modern Italy.
Challenges to Legal Theory offers the reader a fascinating journey through a variety of multi-disciplinary topics, ranging from law and literature, and law and religion, to legal philosophy and constitutional law. The collection reflects some of the challenges that the field of legal theory currently faces. It is compiled by a selection of international and Spanish scholars, whose essays are made available in English translation for the first time. The volume is based on a collection of essays, published in Spanish, in honour of Professor José Iturmendi Morales, of Complutense University, Madrid, and brings the rich scholarship of pre-eminent Spanish scholars of law and legal theory to an international audience.
In 1807 Napoleon Bonaparte created the Duchy of Warsaw from the Polish lands that had been ceded to France by Prussia. His Civil Code was enforced in the new Duchy too and, unlike the Catholic Church, it allowed the dissolution of marriage by divorce. This book sheds new light on the application of Napoleonic divorce regulations in the Polish lands between 1808-1852. Unlike what has been argued so far, this book demonstrates that divorces were happening frequently in 19th century Poland and even with the same rate as in France. In addition to the analysis of the Napoleonic divorce law, the reader is provided with a fully comprehensive description of parties as well as courts and officials involved in divorce proceedings, their course and the grounds for divorce.
The Roman army represented an important social and organizational reference model for the Romano-Barbarian societies, which progressively replaced the Western Empire in the transition from Late Antiquity to Early Middle Ages. The great flexibility of the decision-making and organizational solutions used by the Roman army allowed the ‘new lords’ to readapt them and thus maintain power in early medieval Europe for a long time. From a perspective ranging from political, social and economic history to law, anthropology, and linguistic, this book demonstrates how interesting and fruitful the investigation of this specific cultural imprint can be in order to gain a better understanding of the origins of the civilization that arouse after the fall of the Roman world. Contributors are Francesco Borri, Fabio Botta, Francesco Castagnino, Stefan Esders, Carla Falluomin, Stefano Gasparri, Wolfgang Haubrichs, Soazick Kerneis, Luca Loschiavo, Valerio Marotta, Esperanza Osaba, Walter Pohl, Jean-Pierre Poly, Pierfrancesco Porena, Iolanda Ruggiero, Andrea Trisciuoglio, Andrea A. Verardi, and Ian Wood.
The collection of essays presented here examines the links forged through the ages between the realm of law and the expressions of the humanistic culture. We collected thirty-five essays by international scholars and organized them into sections of ten chapters based around ten different themes. Two main perspectives emerged: in some articles the topic relates to the conventional approach of law and/in humanities (iconography, literature, architecture, cinema, music), other articles are about more traditional connections between fields of knowledge (in particular, philosophy, political experiences, didactics). We decided not to confine authors to one particular methodological framework, prefer...
More than any other type of environment, with the possible exception of mountains, the sea has been understood since antiquity as being immovable to a proverbial degree. Yet it was the sea's capacity for movement – both literally and figuratively through such emotions as fear, hope and pity – that formed one of the primary means of conceptualizing its significance in Late Antique societies. This volume advances a new and interdisciplinary understanding of what the sea as an environment and the pursuit of seafaring meant in antiquity, drawing on a range of literary, legal and archaeological evidence to explore the social, economic and cultural factors at play. The contributions are struct...
