Mit den 33g und 89b ff. GWB wurden auf Grundlage der Kartellschadensersatzrichtlinie (RL 2014/104/EU) neue Regelungen zur Urkundenvorlage im Kartellschadensersatzprozess geschaffen. Diese Regelungen gehen uber die bestehenden Editionspflichten im allgemeinen Zivilprozess hinaus. Verena Dorothea Kern untersucht, inwieweit die neuen kartellspezifischen Vorschriften der Dogmatik und Terminologie der ZPO entsprechen, und zeigt Defizite in der Umsetzung der Richtlinienvorgaben auf. Anschliessend entwickelt sie einen eigenen Regelungsvorschlag, der den Vorgaben der Richtlinie besser gerecht wird und sich stimmiger in die deutschen Editionsvorschriften einfugt. Die Arbeit wurde mit dem Juratisbona-Preis 2019 des Alumni-Vereins der Fakultat fur Rechtswissenschaft der Universitat Regensburg ausgezeichnet.

Private Schadensersatzklagen bei Kartellverstossen gewinnen zunehmend an Bedeutung. Derartige Kartellprozesse sind jedoch im Ausgangspunkt durch eine erhebliche Informationsasymmetrie gepragt, die eine wirksame Durchsetzung erschwert. Der europaische Gesetzgeber hat sich mit der Kartellschadensersatzrichtlinie dieser Thematik angenommen und in das Recht der Mitgliedstaaten umzusetzende Offenlegungspflichten statuiert. Anja Meier-Hoffmann untersucht die schwerpunktmassig in 33g, 89b f. GWB erfolgte deutsche Umsetzung vor dem Hintergrund bisheriger Informationsbeschaffungsmechanismen sowie hergebrachter Grundsatze des Zivilprozessrechts. Sie geht auf Basis einer Detailanalyse der Einzelregelungen der Frage nach, ob die Novelle sich als inhaltlich und rechtstechnisch zielfuhrende Losung der durch die Informationsasymmetrie verursachten Schwierigkeiten erweist und ob sie als Vorbild fur andere Rechtsgebiete dienen kann.

Archives are considered to be collections of administrative, legal, commercial and other records or the actual place where they are located. They have become ubiquitous in the modern world, but emerged not much later than the invention of writing. Following Foucault, who first used the word archive in a metaphorical sense as "the general system of the formation and transformation of statements" in his "Archaeology of Knowledge" (1969), postmodern theorists have tried to exploit the potential of this concept and initiated the "archival turn". In recent years, however, archives have attracted the attention of anthropologists and historians of different denominations regarding them as historical objects and "grounding" them again in real institutions. The papers in this volume explore the complex topic of the archive in a historical, systematic and comparative context and view it in the broader context of manuscript cultures by addressing questions like how, by whom and for which purpose were archival records produced, and if they differ from literary manuscripts regarding materials, formats, and producers (scribes).

Carl Gustav Carus (1789-1869)--court physician to the king of Saxony--was a naturalist, amateur painter, and theoretician of landscape painting whose Nine Letters on Landscape Painting is an important document of early German romanticism and an elegant appeal for the integration of art and science. Carus was inspired by and had contacts with the greatest German intellectuals of his day. Carus prefaced his work with a letter from his correspondence with Johann Wolfgang von Goethe, who was his primary mentor in both science and art. His writings also reflect, however, the influence of the German natural philosopher Friedrich Wilhelm Joseph Schelling, especially Schelling's notion of a world soul, and the writings of the naturalist and explorer Alexander von Humboldt. Carus played a role in the revolution in landscape painting taking place in Saxony around Caspar David Friedrich. The first edition appears here in English for the first time.
