Mobbing, onere di allegazione e prova del danno
Il tema dei danni conseguenti a mobbing, soprattutto negli ultimi anni, si è molto diffuso, e numerose sono le azioni giudiziarie promosse per conseguire il risarcimento conseguente. Accanto ai problemi connessi alla individuazione delle varie fattispecie di mobbing, e alle modalità di quantificazione dei danni, è necessario esaminare anche i problemi connessi all’onere della prova, o meglio a come lo stesso sia distribuito tra le parti del processo. Con questa pubblicazione gli autori intendono approfondire, anche alla luce della più recente giurisprudenza, più che gli aspetti relativi al mobbing, quelli che concernono l’onere della prova: il tema è certamente noto e studiato, ma questa pubblicazione ha lo scopo di offrire al lettore, oltre a riflessioni sull’onere della prova in generale, anche e soprattutto una guida pratica di come il problema va affrontato sia per l’avvocato, sia nel rapporto che questi deve affrontare con l’assistito.
