Die seit dem Reichspatentgesetz von 1877 ausdrucklich geregelte Vererblichkeit von Rechten an Erfindungen erwuchs weder aus einer historischen Selbstverstandlichkeit noch stellte sie ein Bekenntnis zu einer Dogmatik der Immaterialguterrechte dar. Ausgehend von den venezianischen Erfindungsprivilegien des 15. Jahrhunderts analysiert Maximilian Kiemle europaische und amerikanische Rechtsordnungen hinsichtlich dieser Schnittstelle okonomischer, sozialer, patent-, erb- und personlichkeitsrechtlicher Fragestellungen, um Ruckschlusse auf die zeitgenossische Einordnung dieser Rechte zu ziehen. Damit schlagt er einen weiten Bogen von einer vom Gnadenakt gepragten Erteilung teils vererblicher Privilegien uber das naturrechtlich wie selbstverstandlich ubergehende "Geistige Eigentum" hin zum Theorienstreit um das Patentwesen im Deutschen Kaiserreich vor Ausbruch des Ersten Weltkrieges.
