Legal Orientalism

  • Categories: Law

After the Cold War, how did China become a global symbol of disregard for human rights, while the U.S positioned itself as the chief exporter of the rule of law? Teemu Ruskola investigates globally circulating narratives about what law is and who has it, and shows how “legal Orientalism” developed into a distinctly American ideology of empire.

Custom, Land and Livelihood in Rural South China

Land was always at the centre of life in Hong Kong’s rural New Territories: it sustained livelihoods and lineages and, for some, was a route to power. Villagers managed their land according to customs that were often at odds with formal Chinese law. British rule, 1898—1997, added complications by assimilating traditional practices into a Western legal system. Custom, Land and Livelihood in Rural South China explores land ownership in the New Territories, analysing over a hundred surviving land deeds from the late Ch’ing Dynasty to recent times, which are transcribed in full and translated into English. Together with other sources collected by the author during 30 years of research, these deeds yield information on all aspects of traditional village life—from raising families and making a living to coping with intruders—and evoke a view of the world which, despite decades of urbanisation, still has resonance today.

British Rule in China

Written using official records and other sources, British Rule in China is the first systematic account of the legal history of Weihaiwei, a small territory leased by China to Britain in 1898. It is a fascinating and accessible account of the territory's constitution, laws, courts, judges and magistrates, penal policy, and police force. The book explores the various problems and controversies faced by the local authorities in administering justice as well as their attempts to resolve them. This is the first work to examine thoroughly, through research into the law, the history of Weihaiwei under British rule. Whilst looking also at the legal status of Weihaiwei, its laws and institutions, this work also pays attention to particular aspects of the legal system which had the greatest impact on the lives of the ordinary villagers in this part of China. Based on extensive research of primary sources, British Rule in China is a fascinating and readable account of a legal system and the response of the territory's Chinese residents to it. Territorial Leasing in Diplomacy and International Law focuses on an unexplored but relatively common practice in which states reallocate their rights on territory without altering formal boundaries or resorting to definitive cessions. As products of diplomacy, leases address a frequent situation that, in extreme cases, can lead to war: the desire by more than one state to exercise sovereign authority in the same place. As instruments of international law, they paradoxically reinforce the territorial integrity of states while raising questions about the nature of their sovereignty. This book draws from a large number of leases to examine the practice from historic to modern times, describing their elements in detail and assessing them from both political and legal perspectives.

Land Conflicts Across Frontiers compares Myanmar’s journey with North East India on the critical and contested issue of land. It examines concerns related to land in pre-colonial and colonial history, causes and consequences of land conflicts today, the socioeconomic dynamics attached to land, along with attempted community-based institutional interventions and rural activism. As Myanmar takes its steps towards a democratic future, it becomes critical for the country to be aware of North East India’s experiences, as they could provide valuable lessons of what to ‘implement’ and what to ‘avoid’. Loss of common property resources, non-recognition of customary rights, ambiguous land laws and inadequate attention to people’s grievances have led to a rural landscape which has witnessed livelihood vulnerability, displacement and conflict. The book not only tries to capture cross-border experiences in order to have a better understanding of land alienation, agrarian discontent and peripheral marginalization but also notes recent trends in rural spaces and suggests policy measures.
