More than 200 Islamic financial institutions (IFIs) operate in 48 countries. Their combined assets exceed $200 billion, with an annual growth rate between 12 percent and 15 percent. The regulatory regime governing IFIs varies significantly across countries. A number of international organizations have been established with the mandate to set standards that would strengthen and harmonize prudential regulations as they apply to IFIs. El-Hawary, Grais, and Iqbal contribute to the discussion on the nature of prudential standards to be developed. They clarify the risks that IFIs are exposed to and the type of regulations that are needed to systematically manage them. They consider that the indust...

A Critique of Creative Shari'ah Compliance in the Islamic Finance Industry

  • Categories: Law

Ahmad Alkhamees defines Creative Shari‘ah compliance as compliance with the letter but not the objectives of Shari‘ah. In recent years, Islamic finance industry practises have come under scrutiny, with strong critiques levelled against many institutions that claim to provide Shari‘ah-compliant products and services, which in fact undermine the spirit and the objectives of Shari‘ah. This book significantly contributes to the sphere of Islamic finance in three main ways. First, it critically appraises justifications of creative Shari‘ah compliance practises. Second, it examines how Shari‘ah supervisory board (SSB) governance practises, and the inconsistent fatwas issued by SSBs, contribute to the issue of creative Shari‘ah compliance. Most importantly, it suggests regulatory mechanisms which regulators can employ in Islamic countries such as Saudi Arabia and in secular countries such as the United Kingdom to deal with the issue of creative Shari‘ah compliance.

Perspectives on Power

Although ‘power’ can appear a vague term, the dichotomy between haves and have-nots, the desire to gain autonomy, and the dire consequences of subjugation, are three issues that resound across the arts and social sciences. In this book, postgraduate students from the constituent disciplines use the freedom of their positions as early-career researchers to boldly explore power relations. From a legal perspective, papers are included geared towards human rights issues and violations. Further, the applied perspectives from business and education researchers consider how access to wealth and education, and to equal education, can and must be achieved. Then, interpreted through the perspectiv...
