Allgemeine Geschaftsbedingungen sind allgegenwartig und tauchen keineswegs nur in Form des typischerweise "Kleingedruckten" auf. Das Gesetz unterwirft sie einer deutlich strengeren Inhaltskontrolle als dies bei Individualvereinbarungen der Fall ist. Nur vereinzelt bleiben AGB hiervon verschont. Die Praxis ist insoweit jedoch gepragt von Einzelfallentscheidungen und noch immer kann man festhalten: "Die Rechtsprechung kontrolliert nicht, wo sie darf, sondern wo sie will" (Roth, 1990). Besonders deutlich wird dies im Bereich moderner Vertragstypen des Urheber- und IT-Rechts. Wenzel Steinmetz stellt anhand praxisrelevanter Vertragsgestaltungen die hierzu ergangene Rechtsprechung und Literatur zusammen, untersucht die verfassungs- und unionsrechtlichen Grundlagen der Inhaltskontrolle und entwickelt hieraus einen an Markt und Wettbewerb orientierten Ansatz zur Bestimmung des kontrollfreien Bereichs.
