Die Praxis ist insoweit jedoch gepragt von Einzelfallentscheidungen und noch immer kann man festhalten: "Die Rechtsprechung kontrolliert nicht, wo sie darf, sondern wo sie will" (Roth, 1990). Besonders deutlich wird dies im Bereich moderner Vertragstypen des Urheber- und IT-Rechts.
