The author presents, the 2001/23/CE Directive of the Council which deals with the leveling of the legislations of the member states regarding the rights of the employees in case of the transfer of the enterprise or of the unit or of some parts of the enterprises or the units. Compared to the EU standards, the norms from the Labour Code and from the 67//2006 Law are applicable to the transfer of the enterprises or of the units or of the parts of them regardless of the nature of the registered/authorized capital if they are situated on the Romanian territory.
