Não resta dúvida que o direito processual deve ser tratado exclusivamente por legislação federal, extraindo-se tal diretriz de forma clara do disposto no artigo 22, I, da Constituição Federal de 1988. Contudo, o quadro nem sempre foi assim, eis que durante pequeno hiato temporal de nossa história permitiu-se aos Estados Federados legislar sobre matéria processual, fato que propiciou a edificação de algumas legislações processuais codificadas de cunho estadual. O presente texto traz anotações horizontais que revelam a evolução histórica do direito processual civil até a edição dos códigos de processo civil pelos Estados Federados, focando-se, ao final, na elaboração do Código de Processo Civil do Estado do Espírito Santo, tema que – por ser pouco abordado – é praticamente desconhecido da comunidade jurídica, tanto no âmbito nacional, como também no seu espectro regional.
