Mario Losano è uno studioso eccellente, la cui produzione scientifica sconfina nei più disparati campi del sapere giuridico e oltre: ha arricchito le nostre conoscenze nella filosofia del diritto, nella teoria generale del diritto, nella storia del diritto, nell’informatica giuridica, nel diritto comparato, nella filosofia politica, solo per citare i settori nei quali è una riconosciuta autorità scientifica. È poi un intellettuale mosso da un’autentica passione civile e politica, e anzi un raro esempio di intellettuale: i suoi lavori spiccano per la tensione interdisciplinare, oltre che per caratteristiche decisamente poco diffuse in un mondo sempre più animato da tecnocrati dediti all’iperspecializzazione. Gli autori e le autrici di questi Scritti sono studiosi attivi nel diritto comparato, nella filosofia e nella teoria generale del diritto che hanno inteso celebrare, tra le tante, una particolare virtù dell’Onorato: aver gettato un ponte tra queste discipline, segnandone in modo indelebile l’agenda e lo statuto epistemologico

Los catálogos de derechos humanos consagrados en los instrumentos internacionales, así como aquellos reconocidos en los textos internos de los Estados, se encuentran en permanente evolución. Debido a ello, el estudio de la fundamentación, de la interpretación de los derechos por vía jurisdiccional y el análisis sobre el marco jurídico existente para comprender, son de suma importancia toda vez que el ordenamiento normativo se enfrenta a permanentes retos que en diversas ocasiones cuestionan la eficacia de la norma jurídica. Esta obra plantea las reflexiones contemporáneas que desde diversas áreas del derecho se proyectan como desafíos a la conceptualización, reconocimiento y exigibilidad de los derechos humanos, concebidos desde una perspectiva amplia y flexible. Además representa un esfuerzo académico por cristalizar las relaciones existentes entre el Instituto de Derechos Humanos "Bartolomé de las Casas” de la Universidad Carlos III de Madrid y la Facultad de Jurisprudencia de la Universidad del Rosario, donde se proponen interesantes cuestionamientos a la concepción tradicional de los derechos humanos.

This book features a discussion on the modernisation of law and legal change, focusing on the key concepts of innovation" and "transition". These concepts both appear to be relevant and poorly defined in contemporary legal science. The aim of this article is to analyze the circulation of Rudolf von Jhering's ideas outside of Europe. More precisely, we will show how his thought was introduced in Japan and China, as well as in some Latin American countries: Especially Brazil, but also Chile, Argentina, Peru and Mexico. Before accomplishing this task we will make a draft on the major interpretations that Jhering's thought received within Europe, in order to identify the main hermeneutic orientations that have been proposed to apprehend his work. The methodological standpoint of this contribution states that the phenomenon of cultural translation does not imply a mechanical and passive reception of works or authors. Instead, the circulation of ideas usually leads to processes of transformation and hybridation of the original theories.
