Doch haben die nationalen Regelungen uber das Arzt-Patienten-Verhaltnis Einfluss auf die Arzneitmittelanwendung? Dominika Woclaw analysiert die Pflichten des Arztes aus dem Behandlungsvertrag im Rahmen dieser Frage. Dabei untersucht sie das deutsche Recht, wo der Behandlungsvertrag seit 2013 in den 630a ff. BGB geregelt ist, und das polnische Recht, dem eine vergleichbare Regelung fehlt. Auch die europaische Rechtslage wird in den Blick genommen. Dabei zeigt sie, dass die 630a ff. BGB fur die zukunftige Regelung des Behandlungsvertrages im polnischen ebenso wie im europaischen Recht als Beispiel dienen konnen.
