Perspectives and Guidelines on Food Legislation

The increasing globalization of food trade and the harmonization of food standards and food safety rules have led to significant changes in the international and national regulatory frameworks for food. There is an increasing recognition of the need to integrate and improve coordination of regulatory activities among national and international bodies for better protection of human, animal and plant life and health without creating unnecessary barriers to trade. In addition, catastrophic outbreaks of food-borne disease have sparked increasing attention to the regulatory frameworks for food safety and food trade in the global arena. These developments have given rise to new legislative needs. ...

Administrative Sanctions in Fisheries Law

  • Categories: Law

Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. It is intended to assist states in identifying the issues they need to take into account when considering the adoption of such a scheme. It is expected that the study will be especially valuable to developing states seeking to adopt a cost effective means of dealing with illegal, unreported and unregulated fishing, but which nonetheless wish to ensure that the basic individual rights of the accused are protected.

Food Safety Standards in International Trade

  • Categories: Law

Food safety has become a major concern for consumers in the developed world and Europe in particular. This has been highlighted by the recent spate of food scares ranging from the BSE (mad cow) crisis to Chinese melamine contamination of baby formula. To ensure food safety throughout Europe, stringent food safety standards have been put in place ‘from farm to fork’. At the same time, poor African countries in the COMESA rely on their food exports to the European market to achieve their development goals yet have difficulty meeting the EU food safety standards. This book examines the impact of EU food safety standards on food imports from COMESA countries. It also critically examines both EU and COMESA food safety standards in light of the WTO SPS Agreement and the jurisprudence of the WTO panels and Appellate Body. The book makes ground-breaking proposals on how the standards divide between the EU and the COMESA can be bridged and discusses the impact of EU food safety standards on food imports from poor African countries.

Modernizing Sanitary and Phytosanitary Measures to Facilitate Trade in Agricultural and Food Products

This project study was initiated by the Asian Development Bank (ADB) as part of the Central Asia Regional Economic Cooperation (CAREC) Transport and Trade Facilitation Strategy. Its objective is to identify areas for improvement in the administration and application of sanitary and phytosanitary (SPS) regulations, procedures, and standards in the CAREC region. It recommends a set of concerted, coordinated measures designed to improve and reduce delays in handling perishable goods in transit (and particularly at border crossing points), ensure that food is safe for consumers, and prevent the spread of pests and diseases among animals and plants. The study is based on an examination of SPS measures as applied in the People's Republic of China, Mongolia, Kazakhstan, the Kyrgyz Republic, and Uzbekistan. The study involved a wide-ranging assessment of current procedures for animal and plant quarantine, veterinary inspection, food safety inspection, and risk analysis and assessment, assessing conformity with internationally accepted standards.

Beyond Compliance

Agricultural trade is an engine for economic growth, yet many countries lack the competence and confidence to negotiate market access effectively. Access requires compliance with a set of phytosanitary measures imposed by the importing country. However, by following a structured process, negotiations can move beyond simple compliance to a more mutually beneficial solution. Beyond Compliance: A Production Chain Framework for Plant Health Risk Management in Trade provides a series of decision support tools that can be used to manage and demonstrate plant health risk management. The tools, developed within a production chain framework and Systems Approach, were developed using real trade cases ...
