Non-performance and Remedies Under International Contract Law Principles and Indian Contract Law

The survey compares the rules on contractual non-performance and remedies under the UNIDROIT Principles of International Commercial Contracts, the Principles of European Contract Law, and Indian statutory contract law (including the Indian Contract Act, 1872). Given that most Indian statutes were derived from English law and may therefore be viewed as «codified common law», this comparison may contribute to the question of whether, especially in view of contract law harmonisation in the EU, the civil-law and common-law traditions could be merged in a common code. Moreover, it may help identify legal differences that are relevant to doing business between India and Europe. The general conclusion of the survey is that the Principles and Indian statutory contract law share a close proximity especially because many of their provisions on non-performance and remedies appear to be derived from the same concepts and also provide for very similar consequences.

Good Faith in International Commercial Arbitration

  • Categories: Law

From the perspective of users of international commercial arbitration, the uncertainties surrounding the application of good faith by an arbitral tribunal create an unwelcome unpredictability. Acknowledging this prevalent situation, this book is the first to study in depth the available international arbitral awards that have applied good faith, thus providing detailed guidance on how this notion is (and can be) applied by tribunals in international commercial arbitration. Moreover, the author proposes a set of deeply informed guidelines for the future application of good faith by arbitral tribunals to both the parties’ contract and the arbitration agreement. This book provides a comprehen...

Towards a Science of International Arbitration

  • Categories: Law

Most books on international commercial arbitration approach the subject through legal theory supported by anecdotal evidence. This remarkable book is distinguished by its focus on the application of quantitative empirical research to the study of international arbitration. It collects, together with commentary, the existing empirical literature on the subject, and also presents several studies published here for the first time. Beginning with a basic overview of the methods of empirical research (surveys, observational studies, experimental studies), the book goes on to reprint the existing empirical studies under six headings: why parties agree to arbitrate; arbitration clauses; arbitral pr...

Article 6 of the Paris Agreement establishes three approaches for Parties to cooperate in achieving their nationally determined contributions (NDCs). One of these approaches is a new mechanism “to contribute to the mitigation of greenhouse gas emissions and support sustainable development” (Art. 6.4(a)). The detailed rules, modalities and procedures (RMP) for the operationalization of this mechanism are currently being negotiated. The aim of this project has been to contribute to the development of the RMP for the new mechanism by analysing a range of design questions: What are options for achieving an overall mitigation of global emissions, as mandated by Art. 6.4(d) of the Paris Agreem...
