Relational Designs in Literature and the Arts
This collection focuses on texts that address the other arts – from painting to photography, from the stage to the screen, and from avant-garde experiments to mass culture. Despite their diversity of object and approach, the essays in Relational Designs coalesce around the argument that representations are defined by relations and dynamics, rather than intrinsic features. This rationale is supported by the discourses and methodologies favoured by the book’s contributors: their approaches offer a cross section of the intellectual and critical environment of our time. The book illustrates the critical possibilities that derive from the broad range of modes of inquiry - poststructuralist criticism, gender studies, postcolonial studies, new historicism – that the book’s four sections bring to bear on a wealth of intermedial practices. But Relational Designs compounds such critical emphases with the voice of the practitioner: the book is rounded off by an interview in which a contemporary novelist discusses her attraction to the other arts in terms that extend the book’s insights and bridge the gap between academic discourse and artistic practice.
Renaissance Shakespeare/Shakespeare Renaissances
Selected contributions to the Ninth World Shakespeare Congress, which took place in July 2011 in Prague, represent the contemporary state of Shakespeare studies in thirty-eight countries worldwide. Apart from readings of Shakespeare’s plays and poems, more than forty chapters map Renaissance contexts of his art in politics, theater, law, or material culture and discuss numerous cases of the impact of his works in global culture from the Americas to the Far East, including stage productions, book culture, translations, film and television adaptations, festivals, and national heritage. The last section of the book focuses on the afterlife of Shakespeare in the work of the leading British dramatist Tom Stoppard. Published by University of Delaware Press. Rethinking Natural Law
For centuries, natural law was the main philosophical legal paradigm. Now, it is a wonder when a court of law invokes it. Arthur Kaufmann already underlined a modern general "horror iuris naturalis". We also know, with Winfried Hassemer, that the succession of legal paradigms is a matter of fashion. But why did natural law become outdated? Are there any remnants of it still alive today? This book analyses a number of prejudices and myths that have created a general misconception of natural law. As Jean-Marc Trigeaud put it: there is a natural law that positivists invented. Not the real one(s). It seeks to understand not only the usual adversaries of natural law (like legalists, positivists and historicists) but also its further enemies, the inner enemies of natural law, such as internal aporias, political and ideological manipulations, etc. The book puts forward a reasoned and balanced examination of this treasure of western political and juridical though. And, if we look at it another way, natural law is by no means a loser in our times: because it lives in modern human rights.
Constitucionalismo Decolonial
A construção do pensamento ocidental da modernidade, com nítidos reflexos no pensamento jurídico, promoveu uma razão pretensamente humana, mas de todo especificamente burguesa, baseada na lógica empresarial capitalista de maximização dos lucros. Disto resultou, dentre outras mazelas de cunho ambiental, político, socioeconômico etc., o sufocamento da autonomia de comunidades tradicionais, no plano etnográfico, com destaque para os quilombos, que lutam por respeito à sua identidade e territorialidade. A superação desse problema está sendo proposta aqui a partir da formação de um conceito que se apresenta como um "Constitucionalismo Decolonial", que possa levar a uma nova práxis jurídica e política, visando efetivar a construção de uma sociedade solidária.
