Falsas memórias no processo penal e direito a um julgamento justo
A obra versa acerca de dois temas principais: o direito ao julgamento justo e o fenômeno das falsas memórias. O objetivo central da pesquisa é verificar como as falsas memórias podem interferir no processo penal e indicar soluções para diminuir seus impactos negativos, sobretudo os prováveis erros judiciários advindos do fenômeno. Nesse sentido, serão analisadas as bases constitucionais do Direito ao Julgamento Justo, a mitologia existente no direito processual penal, especificamente a relativa ao princípio da verdade real e sua mitigação em razão de múltiplos fatores, como, por exemplo, as memórias falsas. Também será estudada a influência do fenômeno nas provas testemunhal e de reconhecimento de pessoas. Por fim, serão propostas algumas soluções para diminuição do impacto das falsas memórias no processo criminal. Para tanto, o método dedutivo foi utilizado, bem como a pesquisa bibliográfica, urisprudencial e legislativa, com a finalidade de obter um conhecimento bastante amplo acerca dos temas pesquisados.
