New Constitutionalism in Latin America

Latin America has a long tradition of constitutional reform. Since the democratic transitions of the 1980s, most countries have amended their constitutions at least once, and some have even undergone constitutional reform several times. The global phenomenon of a new constitutionalism, with enhanced rights provisions, finds expression in the region, but the new constitutions, such as those of Bolivia, Colombia, Ecuador and Venezuela, also have some peculiar characteristics which are discussed in this important book. Authors from a number of different disciplines offer a general overview of constitutional reforms in Latin America since 1990. They explore the historical, philosophical and doct...

This book addresses key challenges and conflicts arising in extractive industries (mining, oil drilling) concerning the human rights of workers, their families, local communities and other stakeholders. Further, it analyses various instruments that have sought to mitigate human rights violations by defining transparency-related obligations and participation rights. These include the Extractive Industries Transparency Initiative (EITI), disclosure requirements, and free, prior and informed consent (FPIC). The book critically assesses these instruments, demonstrating that, in some cases, they produce unwanted effects. Furthermore, it highlights the importance of resistance to extractive industry projects as a response to human rights violations, and discusses how transparency, participation and resistance are interconnected.

The scholarly debate on deliberative democracy often suggests that participatory processes will contribute to make environmental governance not only more legitimate and effective, but also lead to the empowerment of marginalized social groups. Critical studies, however, analyse how technologies of governance make use of participation to draw boundaries that separate technical knowledge from political concerns, direct the focus towards procedural aspects and contractual obligations, and reinforce hegemonic understandings of development and of local people’s relationships to their environment. This book focuses on the dynamics and use of participatory mechanisms related to the rapid expansio...

Autocracies not only resist the global spread of democracy but are sources of autocratic influence and pressure. This book presents a conceptual model to understand, assess, and explain the promotion and diffusion of authoritarian elements. Employing a cross-regional approach, leading experts empirically test the concept of authoritarian gravity centers (AGCs), defined as "regimes that constitute a force of attraction and contagion for countries in geopolitical proximity." With an analysis extending across Latin America, the Middle East, Eastern Europe, Central Asia, and Asia, these AGCs are shown to be effective as active promoters (push) or as neutral sources of attraction (pull). The auth...

Business, Human Rights and the Environment: The Evolving Agenda

  • Categories: Law

More than ten years after the adoption of the UN Guiding Principles on Business and Human Rights, this book critically reviews the achievements, limits and next frontiers of business and human rights following the ‘protect, respect, remedy’ trichotomy. The UN Guiding Principles acted as a catalyst for hitherto unprecedented regulatory and judicial developments. The monograph by Macchi proposes a functionalist reading of the state’s duty to regulate the transnational activities of corporations in order to protect human rights and adopts a holistic approach to the corporate responsibility to respect, arguing that environmental and climate due diligence are inherent dimensions of human ri...

Violence Against Women in Politics

"Women have made significant inroads into politics in recent years, but in many parts of the world, their increased engagement has spurred physical attacks, intimidation, and harassment intended to deter their participation. This book provides the first comprehensive account of this phenomenon, exploring how women came to give these experiences a name - violence against women in politics - and lobbied for its increased recognition by citizens, states, and international organizations. Tracing how this concept emerged inductively on the global stage, the volume draws on research in multiple disciplines to resolve lingering ambiguities regarding its contours. It argues that this phenomenon is n...
