La presente investigación versa sobre el estudio de la figura de la mediación; desarrollada desde la perspectiva de implementarse como solución alternativa de conflictos que otorgue las garantías constitucionales de la tutela efectiva de la justicia (tutela judicial efectiva; art. 24.1º CE). Para ello; verificamos si las actuales leyes de mediación españolas cumplen dentro de su articulado con los contenidos básicos establecidos por el Tribunal Constitucional sobre “tutela judicial efectiva ─TJE─” (ver los pronunciamientos del TC en la introducción al capítulo II); toda vez que defendemos que cualquier ley que reglamente una alternativa de resolución de conflictos no solamente debe respetar que las personas involucradas en el conflicto puedan acudir en cualquier momento al proceso judicial sino que dentro del articulado de la norma que la regule deben integrarse todos y cada uno de los contenidos básicos de la tutela efectiva de la justicia (actualmente; TJE) logrando así que se integren todas las vías legales de solución a los conflictos dentro de una sola Administración de la Justicia.
A justiça tributária tradicional tem vindo a apresentar algumas fragilidades. Tais fragilidades têm um ponto em comum: o défice de consciência ético-tributária. Este défice de consciência ético-tributária conduziu, no seio da justiça tributária tradicional, a um conjunto de problemas de ordem substantiva e adjetiva (ao nível do sistema administrativo e judicial). Urge encontrar soluções para os referidos problemas. Tais soluções permitem-nos falar na realização de uma nova justiça tributária, embora sem a pretensão de anular, ou de substituir, a justiça tributária tradicional. Em nosso entendimento, os instrumentos fundamentais para a realização de uma nova justiça tributária - que não afasta, como se referiu, a tradicional, reforçando-a - reconduzem-se a duas dimensões basilares, nomeadamente, a prevenção da litigiosidade e o recurso aos denominados meios alternativos de resolução de litígios, tais como a mediação, a conciliação e a arbitragem.
