La Constitución Nacional reconoce el derecho de las autoridades indígenas para ejercer funciones jurisdiccionales dentro de su ámbito territorial, de conformidad con sus propias normas y procedimientos. Una profusa jurisprudencia de las Altas Cortes colombianas ha ido determinando los contornos de esta función jurisdiccional, las materias sobre las que se aplica y los límites a los que se ve sometida. De similar manera, en este conjunto de sentencias se han ido trazando los criterios de competencia que determinan cuándo un delito es juzgado por la jurisdicción ordinaria y cuándo por la jurisdicción especial indígena. Esta obra hace un recuento de las reglas dogmáticas que se aplican en estos casos, restituye los debates conceptuales y doctrinales que han generado fricciones y compara el ámbito de aplicación del derecho propio indígena con el de los otros países del mundo andino.
