La presente monografía aborda el estudio de la hipoteca flotante del artículo 153 bis de la Ley Hipotecaria. Se trata de una modalidad hipotecaria que permite garantizar una o más obligaciones, presentes y/o futuras, incluso sin conexión causal entre ellas. No exige individualizar la responsabilidad máxima hipotecaria atribuida a cada una de las obligaciones garantizadas, por lo que cada euro de la responsabilidad hipotecaria cubre cada euro de los créditos garantizados (la “indiferenciabilidad” típica de esta hipoteca).
