Die Versammlungsfreiheit ist ein normativer Bestandteil einer funktionierenden Demokratie. Dies gilt insbesondere für die georgische Demokratie, die sich im Prozess der rechtlich-politischen Transformation befindet. Vor diesem Hintergrund zeigt Ketevan Giorgishvili vor allem die "Konfliktkultur" der Versammlungsfreiheit auf, die entsprechende "Legitimationspotenziale" zwischen den Wahlperioden beinhaltet. Die allgemeine gesellschaftlich-politische Relevanz der Versammlungsfreiheit impliziert auch besondere verfassungsrechtliche Bindungen bei der Konkretisierung der Versammlungsfreiheit. Die Autorin verdeutlicht erstmalig die Spezifik des einfachen Versammlungsrechts und der sogenannten "versammlungsrechtlichen Gefahrenabwehr" in Georgien. In Anbetracht der erzielten Ergebnisse und anhand der Rechtsprechung des EGMR fordert sie die Nachbesserung der georgischen Rechtslage. Nur so kann die Versammlungsfreiheit ihre verfassungsrechtliche Qualität als responsives Recht beanspruchen.
