Arbitragem e Valor Probatório da Conduta da Parte
É tormentoso que uma parte possa não conseguir demonstrar seu direito porque não consegue acessar uma prova que seu oponente retém injustificadamente. Na arbitragem, é especialmente desafiador encontrar uma solução para essa situação, dada a limitação dos poderes dos árbitros na imposição de suas decisões. Soma-se a isso o ambiente propício à convivência de atores com experiência em sistemas processuais diferentes e à confluência de normas com diferentes graus de imperatividade em um cenário de tradicional pouca regulação. A partir disso, este livro analisa, à luz da lei brasileira, a técnica de estabelecimento de uma conclusão negativa pelo julgador a partir da recusa da parte em produzir uma prova sob seu controle, isto é, a técnica de extração de inferências adversas pelos árbitros. Espera-se contribuir para o debate sobre o tema e incentivar a aplicação dessa relevante ferramenta com preservação das garantias fundamentais do processo e ganho de previsibilidade para os envolvidos no processo arbitral.
Arbitragem nos Dissídios Individuais Trabalhistas
Este trabalho examina as mudanças introduzidas pela Lei n. 13.467/2017, conhecida como Reforma Trabalhista, que alterou a Consolidação das Leis do Trabalho (CLT), permitindo a livre estipulação da arbitragem na resolução de dissídios individuais trabalhistas para empregados com remuneração superior a duas vezes o teto do INSS. A tese central defende que a arbitragem é um meio adequado para resolver disputas trabalhistas individuais, mas necessitava de uma previsão normativa clara, agora fornecida pelo artigo 507-A da CLT. A pesquisa inclui uma análise comparativa com a legislação espanhola, que proíbe a arbitragem em questões trabalhistas. Utilizando métodos analítico, descritivo e interdisciplinar, a pesquisa conclui que, cinco anos após a Reforma, a arbitragem se consolidou como um instrumento eficaz na resolução de conflitos trabalhistas, com dados recentes confirmando sua aplicação, enquanto o uso indevido deve ser controlado pela Justiça do Trabalho e pelo Ministério Público do Trabalho.
Limites da liberdade processual
Os estudos que deram origem a primeira edição desta obra ocorreram entre os anos de 2017 e 2019, fruto do estágio de pós-doutorado realizado perante a prestigiosa Faculdade de Direito da USP.
