Este trabalho examina as mudanças introduzidas pela Lei n. 13.467/2017, conhecida como Reforma Trabalhista, que alterou a Consolidação das Leis do Trabalho (CLT), permitindo a livre estipulação da arbitragem na resolução de dissídios individuais trabalhistas para empregados com remuneração superior a duas vezes o teto do INSS. A tese central defende que a arbitragem é um meio adequado para resolver disputas trabalhistas individuais, mas necessitava de uma previsão normativa clara, agora fornecida pelo artigo 507-A da CLT. A pesquisa inclui uma análise comparativa com a legislação espanhola, que proíbe a arbitragem em questões trabalhistas. Utilizando métodos analítico, descritivo e interdisciplinar, a pesquisa conclui que, cinco anos após a Reforma, a arbitragem se consolidou como um instrumento eficaz na resolução de conflitos trabalhistas, com dados recentes confirmando sua aplicação, enquanto o uso indevido deve ser controlado pela Justiça do Trabalho e pelo Ministério Público do Trabalho.
