La prueba científica
La ciencia es uno de los conocimientos más fiables para resolver casos con trascendencia jurídica. Sin embargo, debatir sobre su validez y fiabilidad en la audiencia de juicio oral es uno de los temas de vanguardia en el sistema penal acusatorio. En el presente texto, el autor analiza los debates actuales en torno a la cientificidad de la prueba pericial, haciendo énfasis en que no toda prueba pericial es prueba científica, y que el cientificismo basado en el método científico es un tema obsoleto frente al pluralismo epistemológico y las metodologías de los sistemas complejos hacia donde avanza la ciencia forense moderna. Asimismo, examina la validez científica y fiabilidad metodológica del dictamen pericial, cuando su andamiaje teórico-conceptual es compatible con el paradigma de ciencia desde donde se legitima la práctica de campo y la metodología aplicada con criterios epistemológicos específicos y acordes con su identidad.
