Der Anspruch ist die Zentralkategorie des Privatrechts. Seine Legaldefinition ( 194 Abs. 1 BGB) verleiht dem "Anspruch" eine gewisse Stabilitat und jeder Jurist bedient sich des Kriteriums alltaglich ohne weiteres Hinterfragen. Nahere Betrachtung erhellt indessen, dass das Anspruchskriterium mit einer ganzen Reihe von Unsicherheiten verbunden ist. Deren Relevanz illustriert das Problem der Anspruchsentstehung als Anknupfungspunkt fur den Verjahrungsbeginn. Aufbauend auf den historischen Grundlagen und einem rechtsvergleichenden Seitenblick prazisiert Thomas Winkelmann das Anspruchskriterium funktional-teleologisch: Der Anspruch hat privatrechtsubergreifend ausschliesslich in der Funktion als rechtsverwirklichendes Schutzrecht einen sinnvollen Gehalt. Die Anspruchsentstehung lasst sich deshalb universell in Abhangigkeit von einer Rechtsverletzung bestimmen. Dieser Ansatz erlaubt es, uberall dort, wo das geltende Recht an den Anspruch anknupft, Probleme prazise und widerspruchsfrei zu losen.

Based on ethnographic research of contemporary groups in Germany, Scandinavia and North America, the book examines this alternative Neopagan religion’s transformations towards respectability and mainstream thought after the 1970s. It asks which regressive and progressive elements of a National Romantic discourse on Norse myth have shaped Germanic Neopaganism. It demonstrates how these ambiguous ideas about Nordic myth permeate general discourses on race, religion, gender, sexuality, and aesthetics. Ultimately, Norse Revival raises the question whether Norse mythology can be freed from its reactionary ideological baggage.
