Im Zivilprozess spielen Informationsansprüche eine wichtige Rolle. Dennoch besteht für die Richtigkeit der Informationsgabe bisher keine Kontrollmöglichkeit. Nur die eidesstattliche Versicherung hält den Schuldner zur hinreichenden Informationsgabe an. Um eine wirkliche Kontrolle der Informationsgabe zu ermöglichen, bedarf es überschießender Informationen. Im Rahmen des vorgestellten arca-nigra-Verfahrens, einem speziellen in-camera-Verfahren, kann das Gericht sich diese Informationen beschaffen. Ermächtigungsgrundlage sind die §§ 142, 144 ZPO n.F. Der so geschaffene Kontrollmechanismus kann für eine Steigerung des Geheimnisschutzes genutzt werden.
