Rewriting a Constitution
This book describes the challenging journey taken by a post-Soviet transition country to strengthen the rule of law, to introduce a more balanced constitution, and to establish a stronger parliament. By order of President Saakashvili, constitutional reform in Georgia was coordinated by a State Commission, however the opposition formed an alternative commission which introduced a counter proposal. The book provides a fascinating behind-the-scenes account of the path to constitutional reform in Georgia in its historical, legal, and political context and includes commentaries by two experts of international constitutional law. It also offers a rare insight into Germany's impressive contribution to legal reform in the southern Caucasus region in recent decades, including active donor coordination, open discussion on constitutional reforms, regional dialogue, and awareness-building campaigns.

Das georgische Versammlungsrecht im Schnittpunkt von Verfassungs- und Verwaltungsrecht
Die Versammlungsfreiheit ist ein normativer Bestandteil einer funktionierenden Demokratie. Dies gilt insbesondere für die georgische Demokratie, die sich im Prozess der rechtlich-politischen Transformation befindet. Vor diesem Hintergrund zeigt Ketevan Giorgishvili vor allem die "Konfliktkultur" der Versammlungsfreiheit auf, die entsprechende "Legitimationspotenziale" zwischen den Wahlperioden beinhaltet. Die allgemeine gesellschaftlich-politische Relevanz der Versammlungsfreiheit impliziert auch besondere verfassungsrechtliche Bindungen bei der Konkretisierung der Versammlungsfreiheit. Die Autorin verdeutlicht erstmalig die Spezifik des einfachen Versammlungsrechts und der sogenannten "versammlungsrechtlichen Gefahrenabwehr" in Georgien. In Anbetracht der erzielten Ergebnisse und anhand der Rechtsprechung des EGMR fordert sie die Nachbesserung der georgischen Rechtslage. Nur so kann die Versammlungsfreiheit ihre verfassungsrechtliche Qualität als responsives Recht beanspruchen.

Die Enquête-Kommissionen des Deutschen Bundestages blicken mittlerweile auf eine über dreißigjährige Geschichte zurück - Grund genug, endlich eine Bilanz vorzulegen. Diese erste Gesamtdarstellung beleuchtet die eingesetzten wie die nicht eingesetzten Enquête-Kommissionen. Letztere wurden von der Forschung z.T. noch gar nicht wahrgenommen. Der Autor untersucht vier Ebenen: die Konstituierung, das Innenleben, die Ergebnisse und die Wirkungen der Enquête-Kommissionen. Die Analyse basiert u.a. auf über 130 Interviews mit Abgeordneten und Sachverständigen.
