O Direito das Infraestruturas, como novo Direito, engloba o estudo do conjunto de elementos ou serviços que se consideram necessários para a criação e funcionamento de uma determinada atividade econômica. É uma nova área que tem sua essência no aprofundamento do processo de desestatização e regulação de diferentes mercados; na análise do desmembramento de atividades complementares ou ligadas a uma mesma cadeia produtiva, bem como no estabelecimento de concorrência em diferentes fases das atividades; na definição de uma mesma atividade de distintas naturezas jurídicas (serviço público e atividade econômica em sentido estrito); na busca de novos mecanismos de gestão e financiamento para evitar que as infraestruturas dos distintos setores entrem em colapso; entre outros. The Uses of Discretion
Discretion is a pervasive phenomenon in legal systems.
