Verjährung im Strafrecht
Anders als die Diskussion um die Begründung der staatlichen Strafe, der nahezu jedes aktuelle Lehrbuch des Strafrechts einen eigenen Abschnitt widmet, wurde die Diskussion um das zeitlich bedingte Ende dieser Sanktion bisher nur selten geführt. Im Institut der Verjährung trifft das Phänomen des Rechts auf dasjenige der Zeit. Martin Asholt diskutiert und analysiert die historische und strafrechtstheoretische Seite des Aufeinandertreffens der beiden Phänomene eingehend und entwickelt daraus das Konzept des Erlöschens der "Unrechtsrelevanz" in der Zeit. Auf dieser theoretischen Grundlage werden die einzelnen Ausprägungen des Verjährungsrechts (Fristen, Unterbrechung, Ruhen etc.) näher untersucht.
