Swiss Legal History
As the first legal history of Switzerland in English, this seminal work presents the legal development in the territory of today's Switzerland. Until 1798, the Swiss Confederation consisted of a conglomerate of around 50 local authorities with different constitutional statuses. The number of legislative jurisdictions was even greater; each territory, however small, had its own legal system before 1798. In the 19th century, legal unity was initially created within the framework of cantonal law and, since 1848, at the national level. Key developments of the 20th century were equality between men and women, social legislation and the influence of technological development. The focus of the book is on constitutional history, legal sources and legislation, court proceedings and jurisprudence. Presence of the Cross in Public Spaces
The judgments of the European Court of Human Rights in the case of Lautsi vs. Italy (3 November 2009 and 18 March 2011) served as a catalyst for the debate on the presence of the cross in the public space in a number of European states. What are the effects of this debate? What is the meaning attributed to so-called negative religious freedom viewed in relation to the right to manifest religion and protect tradition and culture? Answers to these and related questions are provided in this volume by experienced contributors, who adopt diversified research perspectives and viewpoints. The analyses presented here concern not only the established democracies of Western Europe, but also post-communist states. Owing to the multifaceted approach thus offered, the book will prove to be helpful in distinguishing the implications of respect for the freedom of thought, conscience and religion from the consequences of diversified constitutional norms adopted in individual states, and also from subjective expectations.
Models of Religious Freedom
In this thesis, the US, Swiss, and Syrian models of religious freedom are illustrated in legal settings. The Analytical Representation comprises more than statements of positive law or mechanical comparison. Each chapter is introduced by thought-forms predominant in the respective legal culture. The objective of the Methodological Representation is to investigate the logic and legitimate pattern by which the US and Swiss judiciary come to the conclusion that an alleged interference is covered under the right to religious freedom. The last dimension, which is the Eclectic Representation, pursues a dual aim. Firstly, the idea is to develop an actual guideline of religious freedom rules, and secondly, to evaluate how much religious freedom is internalized in the US, Swiss, and Syrian legal systems. Redesigning Justice for Plural Societies
This volume examines cases of accommodation and recognition of minority practices: cultural, religious, ethnic, linguistic or otherwise, under state law. The collection presents selected situations and experiences from a variety of regions and from different legal traditions around the world in which diverse societal stakeholders and political actors have engaged in processes leading to the elaboration of creative, innovative and, to a certain extent, sustainable solutions via accommodative laws or practices. Representing multiple disciplines and methodologies and written by esteemed scholars, the work analyses the pitfalls and successes of such accommodative practices, presenting insights into how solutions could or could not be achieved. The chapters address the sustainability and transferability of such solutions in order to further the dialogue in both scholarly and policy spheres. The Crisis of Representation
The term “Crisis of Representation” rose to fame through Michel Foucault. The crisis, in the context of this issue, has not only a political and economic dimension, but a cultural, aesthetic and religious one as well. Thus, a serious inquiry into this complex and multidimensional phenomenon requires an interdisciplinary approach. The issue targets the phenomena at hand through 15 contributions – all with unique and innovative approaches to the topic. One common aim that holds the issue together is the analysis of the nature of the crisis, which helps to find suitable theoretical frameworks. On the other hand, the term itself functions as a tool that enables the analysis of specific societal developments. Contributing authors brought with them expertise from their respective fields including philosophy, political sciences, theology, Islamic studies and religious studies. This allowed for a cross-disciplinary approach on the phenomenon with special foci on politics, religions, societies and finance, as well as theoretical developments on current philosophical and post-colonial discourses.
Reception of the 'Limited liability company (GmbH)'
The limited liability company (GmbH) was created by the German legislature in 1892 as a company form without any historical forerunners or suggestions from comparative law. It brought about a readjustment of the relationship between the chance of profit and the liability risk. However, criticism from the jurisprudence that had not been included in the quick legislative process was also heard from the start. As early as 1892, Levin Goldschmidt expressed concern that the GmbH would replace 'principally more solid forms of company'. However, this criticism did not prevent the company form of the GmbH from being adopted in numerous European countries, or at least seriously considering its reception.
