Analisa-se, para tanto, a legislação, a doutrina, julgados do Supremo Tribunal Federal (STF) e do Superior Tribunal de Justiça (STJ), o Código Modelo de Processos Coletivos para Ibero-América, os Anteprojetos de Código Brasileiro de Processos Coletivos elaborados, por um lado, no âmbito da Universidade de São Paulo, e, de outro, no da Universidade Estadual do Rio de Janeiro e Universidade Estácio de Sá, bem como o Projeto de Lei 5.139/2009, com origem no Poder Executivo, que consolida e regula a ação civil pública e outras ações coletivas, e o Projeto de Novo Código de Processo Civil, isto é, Projeto de Lei 6.025/2005 e apensos, ambos em trâmite na Câmara dos Deputados.
