Il risarcimento del danno tra genitori e figli
Il volume costituisce un’indagine tra le possibili reciproche interferenze fra due settori tradizionalmente distinti del diritto privato: la famiglia e la responsabilità civile. Più precisamente si vuole esaminare se, e a quali condizioni, anche all’interno dei rapporti tra i familiari, con specifico riferimento ai rapporti tra i genitori e i figli, possa operare lo strumento del risarcimento del danno. L’opera si inserisce nel dibattito sorto all’interno della letteratura giuridica in seguito alle recenti pronunce giurisprudenziali che sembrano aver riconosciuto il risarcimento del danno di tipo non patrimoniale cagionato dal genitore a danno del figlio. Nel corso del lavoro sono state pertanto esaminate le sopra citate sentenze, nel tentativo di delineare i confini entro i quali ammettere l’operatività della responsabilità civile tra genitori e figli, in via concorrente e sussidiaria rispetto ai tradizionali rimedi di tipo strettamente giusfamiliare.
