Strafbarkeit der Beschneidung von Jungen im Kindesalter?
Der strafrechtliche Umgang mit der medizinisch nicht notwendigen männlichen Genitalbeschneidung im Kindesalter ist in der Schweiz umstritten und beschäftigt die Strafrechtspraxis und -wissenschaft. Es existiert weder eine Strafvorschrift wie im Falle der weiblichen Genitalverstümmelung noch eine Norm, die die medizinisch nicht indizierte Zirkumzision an noch urteilsunfähigen Jungen unter bestimmten Bedingungen erlaubt, wie im deutschen Recht. Die Frage, ob die sog. Knabenbeschneidung tatbestandlich Körperverletzung ist und unter welchen Voraussetzungen sie ggf. als gerechtfertigt erscheint, lässt sich genauso nur interdisziplinär beantworten wie die Frage der Gebotenheit einer strafrechtlichen Verfolgung. Es greifen straf-, zivil- und verfassungsrechtliche Aspekte ineinander und diese treffen auf medizinische, anthropologische, theologische und kulturelle Gegebenheiten. Im April 2022 fand eine Tagung an der Universität Luzern statt, die diese Perspektiven aufgegriffen und diskutiert hat.
