Die vorgerichtliche Beweishilfe im gewerblichen Rechtsschutz und Urheberrecht
Häufig scheitert eine effektive Geltendmachung von Rechten des geistigen Eigentums bereits an einem Mangel an Informationen über den Verletzer oder die Verletzung. Zur Verbesserung der Durchsetzungsmöglichkeiten hat der europäische Gesetzgeber die sogenannte Enforcement-Richtlinie erlassen. Ihre Umsetzung in das deutsche Recht erfolgte im Jahr 2008. Im Fokus dieser Arbeit stehen die Möglichkeiten zur Aufklärung von Rechtsverletzungen durch Auskunfts-, Vorlage- und Besichtigungsansprüche. Die neue Rechtslage wird flächendeckend dargestellt und die Umsetzung der Richtlinie - auch unter Berücksichtigung britischer und französischer Lösungsmodelle - kritisch gewürdigt sowie auf ihre Richtlinienkonformität überprüft. Abgerundet wird die Untersuchung durch den Aufweis diverser Reformdefizite.

Therapie unter Zwang - ein Widerspruch?
Sind Verhaltenstherapie und Zwang - wie immer wieder behauptet - unvereinbar? Schliessen sich Freiheitsentzug und Beziehungsarbeit gegenseitig aus?
