As sociedades de notação de risco e o crime de manipulação do mercado
As sociedades de notação de risco (agências de rating) ganharam, em especial na última década, um protagonismo extraordinário, desempenhando uma função informativa essencial no mercado de instrumentos financeiros. As suas notações podem, contudo, ditar a própria viabilidade de empresas ou criar dificuldades acrescidas às entidades avaliadas, incluindo Estados soberanos. Na presente obra apresenta-se a atividade de notação de risco e analisa-se a tipicidade do crime de manipulação do mercado. Uma das conclusões fundamentais alcançadas foi a possibilidade de distinguir a opinião ínsita numa notação de risco dos pressupostos fácticos que lhe subjazem. Estes, enquanto informação, podem realizar o crime de manipulação do mercado. São ainda apresentadas várias hipóteses de realização típica do crime bem como a enunciação dos principais problemas sobre autoria e participação no âmbito da sociedade de notação de risco.
