DESJUDICIALIZAÇÃO DA EXECUÇÃO FISCAL
Ao lado dos demais Poderes que compõe o estado democrático de direito, o Poder Judiciário figura como aquele responsável pelo julgamento de conflitos de interesse entre cidadãos, pessoas naturais ou jurídicas (públicas ou privadas) que se socorrem da organização judiciária como alternativa para resolução de seus litígios. Entretanto, não obstante o essencial papel cumprido pelo Poder Judiciário, não é novidade o problema da morosidade processual que o assola e que, há décadas, vem sendo discutida. Sem olvidar dos benefícios processuais trazidos pela implementação da arbitragem e dos métodos alternativos de resolução de conflitos, dados oficiais indicam que as reformas na lei processual não atingiram o fim almejado no combate a morosidade e as consequências dela advindas (CNJ, 2022; PGFN, 2022; IPEA 2011). Isto porque as reformas implementadas não tiveram o condão de evitar que a Fazenda Pública, estatisticamente um dos maiores litigantes do país (CNJ, 2022), continuasse a congestionar a organização judiciária no ajuizamento e promoção dos processos executivos fiscais que lhe competem.
